Terms of Service

I reserve the right to refuse service to anyone.Commissions
GENERAL
For clarity purposes, anyone ordering services or considering ordering services from me (the "Artist") will be referred to as the "Client". The order placed by the Client will be referred to as the "commission", the "project", or the "product".
✧ The Artist retains the right to reject projects for any reason including, but not limited to: current workload, previous grievances with the Client, or the character/idea doesn't suit the Artist's style.
✧ Upon ordering from the Artist, the Client automatically agrees to this TOS in full, and gives the Artist permission to accept the Client's payment and use the funds, upon delivery of the final product, however the Artist sees fit.
✧ Upon ordering from the Artist, the Client automatically agrees and understands in full that the Artist will utilize any of the art programs at their disposal (Clip Studio, Paint Tool Sai, Photoshop) for any part of the process the Artist deems fit until the completion of the project.
✧ Upon ordering from the Artist, the Client automatically agrees and understands in full that the Artist will not provide products in any other Artist's style, and not being satisfied with the Artist's style is not a reason to request and/or force a refund later on.BOUNDARIES

In the event the Artist accepts a project that they later realize they cannot accurately portray the Client's OC(s), the Artist will offer the Client a full refund.PAYMENTS
✧ The Client must pay in full before the Artist begins work, unless an agreement has been made between the Client and the Artist privately.REFUNDS
✧ Upon ordering from the Artist, the Client automatically agrees to be completely transparent from the start of the project and until its completion about any changes or additional details they desire to ensure that the final product will be satisfactory to the Client. Final product will only be delivered once the Client has confirmed they are completely satisfied with the product and NO REFUNDS will be allowed after delivery.
✧ If the Client desires a refund for any reason before the completion of the product, the Artist encourages discussion in private so that both parties may attempt to find a reasonable resolution which may include cancellation of the project, a full or partial refund, and/or delivery of unfinished product to the Client.REVISIONS
✧ The Client may request any number of revisions during the sketch stage. Revisions during the line-art and coloring stages are dependent upon what kinds of revisions are necessary.
✧ Large revisions during line-art or later stages that are not of the Artist's fault may require extra charge. Things that would be considered "Artist's fault" would be, for example purposes: changing hair style from the sketch to the line-art stage without Client approval, forgetting a piece of the outfit, coloring something with the wrong shade or color, etc.
✧ The Client agrees, upon automatic acceptance of this TOS by ordering services from the Artist, that the Artist bears no fault for unsatisfactory work due to the Client's own failure to clearly express towards the Artist of any changes that are necessary during any stage of the process.COMMUNICATION
✧ The Artist and the Client will maintain open, ongoing communication from the start of the project and until the completion and final delivery of the product, including updates on the project, idea generation, situation updates, etc.
✧ Communication will be handled through private messages through X (formerly twitter), email, VGEN, or Discord. Response times may vary from a few hours to a few days.DEADLINES AND DELIVERY
✧ Final product delivery may take anywhere from 2 weeks up to 3-5 months depending on the project and whether a specific deadline has been agreed upon between the Client and the Artist. Deadline and Delivery depends entirely on the type, quantity, and complexity of product(s) ordered, as well as current workload.
✧ The Artist vows to not take on more work than they can complete in a reasonable time-frame.
✧ The Artist will communicate with the Client upon starting work on the product, and maintain communication until its completion to the Client's satisfaction. The Client agrees, upon automatic acceptance of this TOS by ordering services from the Artist, to provide feedback on the work in progress in the event any changes are necessary.
✧ In the event of circumstances outside the Artist's control (I.E. broken tablet/computer, illness, natural disaster, etc.) the Artist will give the Client the option to either extend the deadline or to receive a reasonable refund of the product.
✧ Final product will NOT BE DELIVERED until the Client has EXPLICITLY STATED clearly and in full that they are satisfied with the product.USE & INTELLECTUAL RIGHTS
✧ The Client receives exclusive rights to the product for use on their social medias and streaming services. The Client may not claim product as their own work and must credit the Artist with their social media username/link. The Client may pay an additional fee for rights to use final product for merchandise.
✧ The Artist retains copyright and intellectual property rights. The Artist may use the product for display, advertising, and printing, including showcasing the work in progress on social medias, portfolios, and streaming services.
✧ The product may not be used for NFTs.
✧ The product may not be used for AI generation and/or training.Adoptables
